Terms of Service
Effective date: August 24, 2026 · Applies to: Acuitely (“Acuitely,” “we,” “us”)
1. Acceptance of Terms
By creating an account or using Acuitely on behalf of a school, you agree to these Terms. If you're accepting on behalf of a school or organization, you confirm you have authority to do so.
2. Description of Service
Acuitely is a learning intelligence platform that combines learning management, assessment, school management, and learning experience tools for schools and their students, teachers, administrators, and parents.
3. School & User Accounts
Schools are the primary account holder and are responsible for provisioning accounts for their staff, students, and, where applicable, parents, and for ensuring appropriate consent is in place for student use. Individual users are responsible for keeping login credentials confidential.
4. Acceptable Use
The platform may be used only for lawful educational purposes consistent with its intended function. You may not attempt to access data outside your role's scope, disrupt the service, or use it to store or distribute unlawful content.
5. Data & Content Ownership
Schools retain ownership of the data and content they and their users put into Acuitely. We are granted a limited license to process that data solely to provide and improve the service, as described in our Privacy Policy.
6. Subscription & Payment
Fees are set out in the applicable order form or quote agreed with your school, billed per the plan and term selected. Invoices are billed in advance for the agreed term, and renewal and any late-payment terms are set out in that order form.
7. Termination
Either party may terminate as set out in the school's order form. On termination, schools may export their data for a limited period, as described in our Privacy Policy.
8. Disclaimers & Limitation of Liability
The service is provided “as is.” To the extent permitted by law, Acuitely's liability is limited as set out in the applicable order form.
9. Governing Law
These Terms are governed by the laws of the jurisdiction in which Acuitely is incorporated, without regard to conflict-of-law principles.
10. Changes to These Terms
We'll update the effective date above when these Terms change, and notify school administrators of material changes.
